Extension Terms of Use

These Extension Terms of Use (the "Extension Terms") govern your installation and use of the ClerqLegal EOIR Calendar Sync browser extension (the "Extension"), published by ClerqLegal ("ClerqLegal," "we," "us," or "our").

These terms add to the ClerqLegal Terms of Service. The Extension is part of the Services, and the ClerqLegal Terms of Service (the "Terms") apply to it in full, including the sections on accounts and security, your data, acceptable use, third-party services, fees, intellectual property, indemnification, disclaimers, limitation of liability, termination, dispute resolution and arbitration, and governing law. Capitalized terms not defined here have the meanings given in the Terms. If the Extension Terms and the Terms conflict on a point specific to the Extension, the Extension Terms control for that point.

By installing or using the Extension you agree to the Extension Terms, the Terms, and the Extension Privacy Policy. If you use the Extension on behalf of a law firm, you confirm that you are authorized to bind that firm, and "you" includes the firm. If you do not agree, do not install the Extension, or uninstall it.

1. Who may use the Extension

You may use the Extension only if you are an Authorized User of an active ClerqLegal account and you hold your own account with the EOIR case-access portal at case-access.eoir.justice.gov, or are expressly authorized by the holder of that EOIR account to access it on their behalf. The Extension is a tool for practicing attorneys and their staff. It is not for consumers, and it is not for anyone who is not entitled to view the hearing schedule it reads.

2. What the Extension does

When you, or a ClerqLegal page you have opened, trigger a sync, the Extension reads your hearing schedule from the EOIR portal using the EOIR session already signed in to your browser, relays EOIR's responses to ClerqLegal, and shows a progress message. ClerqLegal then stores the hearings in your account and writes them to the calendar you have connected. The Extension makes read-only requests to EOIR, never changes anything there, runs only on clerqlegal.com pages, and stores nothing on your device. The Extension Privacy Policy describes the data it handles in detail.

3. License

Subject to the Extension Terms and the Terms, ClerqLegal grants you a limited, revocable, non-exclusive, non-transferable license to install the Extension in the Google Chrome browser and use it to sync hearing schedules you are authorized to access into your ClerqLegal account. All other rights are reserved. You will not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works of the Extension except as applicable law expressly permits, and you will not remove any proprietary notices from it. The Extension is licensed, not sold.

4. Your EOIR account and your responsibilities

  • Your credentials are yours. The Extension never asks for your EOIR username or password. You are solely responsible for your EOIR account, for keeping it secure, and for signing out on shared computers.
  • Access only what you are entitled to. You will use the Extension only with EOIR accounts you are authorized to use, and only to sync hearings for attorneys whose schedules you are authorized to manage. You will not use the Extension to access, copy, or retain information about cases you have no right to view.
  • Follow EOIR's rules. Your use of the EOIR portal is governed by the terms, notices, and policies of the Executive Office for Immigration Review and the U.S. Department of Justice, and you are responsible for complying with them. If those terms prohibit the kind of access the Extension performs for your account, do not use the Extension.
  • Professional obligations. You remain responsible for your obligations to your clients and to the courts, including confidentiality, competence, calendaring, and timely appearance. The Extension is a convenience, not a substitute for those obligations.
  • Select the right attorney. ClerqLegal rejects a sync when the signed-in EOIR account does not match the attorney selected in ClerqLegal. You are responsible for choosing the correct attorney profile and for being signed in to the correct EOIR account before you run a sync.

5. No affiliation with EOIR or the U.S. government

ClerqLegal and the Extension are not affiliated with, endorsed by, sponsored by, or approved by the Executive Office for Immigration Review, the U.S. Department of Justice, or any other government body. "EOIR" is used only to identify the government system the Extension reads. The official EOIR record, including notices served on you and the schedule shown on the EOIR portal, is the authoritative source for hearing dates and times, and it controls over anything shown in ClerqLegal or on your calendar.

6. Accuracy, availability, and reliance

Verify every hearing. The Extension relays what EOIR returns at the moment of the sync. EOIR data may be incomplete, delayed, rescheduled after the sync, or formatted in a way ClerqLegal cannot fully interpret. Calendar events created from a sync are derived data. You must independently confirm every hearing date, time, and location against the official EOIR record and any notice of hearing you receive, and you must not rely on the Extension or ClerqLegal as your only calendaring system. Missing an immigration hearing can have severe consequences for a client, including an order of removal issued in absentia, and ClerqLegal accepts no responsibility for a missed or mis-calendared hearing.

EOIR may change or break the Extension. The Extension depends on the EOIR portal, which ClerqLegal does not control. EOIR may change its pages, its API, its sign-in process, or its terms at any time, may be unavailable, or may block automated access, and any of those can cause the Extension to stop working without notice. ClerqLegal will make reasonable efforts to restore syncing when it can, but does not guarantee that the Extension will work at any particular time or with any particular version of the EOIR portal.

No guarantee of completeness. A sync may return fewer hearings than exist, may return hearings without respondent names, or may fail partway through. Read the message the Extension shows when a sync finishes, and run the sync again if it reports a problem.

7. Acceptable use

In addition to the acceptable use rules in the Terms, you will not:

  • use the Extension to access an EOIR account without authorization, or to sync a schedule you are not entitled to view;
  • run syncs at a frequency or volume that exceeds normal use by a law practice, or otherwise place unreasonable load on the EOIR portal or the Services;
  • modify the Extension, change the sites it is permitted to contact, or use its components to send requests other than the ones it is designed to send;
  • use the Extension with any browser profile, account, or session that does not belong to you or that you are not authorized to use;
  • use the Extension in a way that violates any law, court rule, rule of professional conduct, or the terms of the EOIR portal or the Chrome Web Store.

8. Updates and discontinuation

The Extension is distributed through the Chrome Web Store, which may install updates automatically. Updates may add, change, or remove functionality and may be required for the Extension to keep working with EOIR or ClerqLegal. ClerqLegal may modify, suspend, or discontinue the Extension at any time, including if changes at EOIR make it impractical to maintain. Discontinuing the Extension does not affect hearings already stored in your ClerqLegal account.

9. Privacy

The Extension Privacy Policy describes what the Extension reads, where it sends it, and what it keeps. The ClerqLegal Privacy Policy governs the data once it reaches ClerqLegal. Data imported through the Extension is Firm Data under the Terms.

10. Chrome Web Store and Google

Your download of the Extension from the Chrome Web Store is also subject to Google's terms for that store. Google is not a party to the Extension Terms, has no responsibility for the Extension or its content, and provides no support for it. Google Chrome and Chrome Web Store are trademarks of Google LLC.

11. Disclaimers

The Extension is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Without limiting the foregoing, ClerqLegal does not warrant that the Extension will be accurate, complete, reliable, uninterrupted, error-free, or compatible with any future version of the EOIR portal or of Google Chrome, or that hearings will reach your calendar. The disclaimers in the Terms apply in full.

12. Limitation of liability and indemnification

The limitation of liability and indemnification sections of the Terms apply to the Extension. Without limiting them, to the fullest extent permitted by law, the ClerqLegal Parties will not be liable for any missed, rescheduled, or mis-calendared hearing, for any order or sanction entered as a result, for any loss of data, or for any indirect, incidental, consequential, special, or punitive damages arising from the Extension, and the total liability of the ClerqLegal Parties arising from the Extension is limited as set out in the Terms. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

13. Termination

You may stop using the Extension at any time by uninstalling it from the chrome://extensions page. ClerqLegal may suspend or terminate your access to the Extension, or disable the sync feature for your account, if you breach the Extension Terms or the Terms, if required by law or by EOIR, or if ClerqLegal discontinues the Extension. Sections 3 (as to the restrictions), 5, 6, 11, 12, 14, and 15 survive termination.

14. Dispute resolution, governing law, and venue

Any dispute arising from the Extension or the Extension Terms is subject to the dispute resolution and arbitration provisions of the Terms, including the agreement to arbitrate on an individual basis, the class action and jury trial waivers, and the 30-day opt-out right described there. The Extension Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, and any proceeding not subject to arbitration will be brought in the state or federal courts located in New Castle County, Delaware.

15. General

The Extension Terms, together with the Terms and the policies they reference, are the entire agreement between you and ClerqLegal about the Extension. If any provision is held unenforceable, the rest remains in effect. ClerqLegal's failure to enforce a provision is not a waiver. You may not assign the Extension Terms without ClerqLegal's consent; ClerqLegal may assign them as part of a merger, acquisition, or sale of assets. We may update the Extension Terms from time to time. The "Last updated" date above shows when they last changed, and continued use of the Extension after a change means you accept it.
